TINDER, District Judge.

This cause comes before the court on Motion to Award Plaintiffs Costs and Reasonable Attorneys’ Fees pursuant to 42 U.S.C. § 1988 (1982). Plaintiffs, residents at the Indiana Girls’ School, filed a declaratory action under 42 U.S.C. § 1983 (1982) against the Commissioner of the Indiana Department of Correction and the Superintendent of the Indiana Girls’ School. This court had jurisdiction pursuant to 28 U.S.C. § 1343 (1982). Plaintiffs, however, voluntarily dismissed this section 1983 action pursuant to Fed.R.Civ.P. 41(a)(2) and then moved this court for an award…
