This appeal is from a judg-' ment in favor of the appellee against the appellant for the sum of $5,000 awarded as damages for personal injuries. The appellant is a private corporation engaged in the manufacture and sale of lumber. In connection with its sawmill it owns and operates a railroad extending 10 or 12 miles into the forest, for the purpose of transporting logs and supplying its mill with timber.
