Marion was convicted on four of six counts of aggravated assault (OCGA § 16-5-21 (a) (2)) and one count of misdemeanor theft by shoplifting (OCGA § 16-8-14 (a) (1), (b) (1)).

Evidence showed department store security personnel observed Marion shoplifting, approached him, and began to escort bim to the security office. Marion broke away, produced a knife, confronted security officer Powell with it, and ran out of the store into the enclosed mall with security officer Scheirer in pursuit.
