James Lamont Johnson appeals from a final judgment entered in the district court for the Eastern District of Missouri upon a jury verdict finding him guilty of escape from lawful custody in violation of 18 U.S. C. § 751(a). On appeal, Johnson alleges, inter alia, that the district court erred in, (1) failing to dismiss his indictment because he fulfilled the terms of a non-prosecution agreement and (2) failing to find that he established a prima facie case of race discrimination in the selection of his jury panel pursuant to Batson v.
