This was a motion for a new trial in ' he court below, and when the case was called for a hearing here, a motion was made to dismiss the plaintiff’s writ of error on the ground that it did not appear that the brief of the evidence in the case had been approved by the court according to law. There was a brief of the evidence agreed on by the counsel of the parties, but no approval thereof by the court. It was recited in the bill of exceptions, that “ both plaintiff and defendant introduced evidence, which is correctly set forth in a brief of evidence filed with a motion…
