(On motion to dismiss writ of error.)
A motion was made tos dismiss this case on the ground that the evidence in the record — particularly the documentary part thereof, is not authenticated in the bill of *13exceptions and record, so as to show that it is that which the superior court had before it on the trial before the jury and on the motion for a new trial.
The bill of exceptions recites that “ a brief of the testimony introduced on the trial has been filed under the revision and approval of the court, and is a part of the record of the cause identified by the signature…
