I. INTRODUCTION
Eleven years after the September 11, 2001, attacks on the Pentagon and World Trade Center and the subsequent invasions of Afghanistan and Iraq, 168 people captured in the Global War on Terrorism remain detained at the United States Naval Base in Guantanamo Bay, Cuba (“Guantanamo”). This matter concerns six of those detainees. At its heart this case is about whether the Executive or the Court is charged with protecting habeas petitioners’ right to access their counsel.
