Bradley Real Estate Trust (Bradley) filed this action seeking a declaration that it was entitled to receive funds held in escrow by Ti-cor Title Insurance Company of California (Ticor). Norwood Plaza Venture (Norwood) filed a counterclaim and later an amended counterclaim and third-party complaint against Bradley, its president E. Lawrence Miller and R.
