Plaintiff, EEX Corporation (“EEX”), commenced this action seeking declaratory and injunctive relief against defendants, United States Department of the Interior (“DOI” or “Interior”), Bruce Babbitt, Secretary of the Interior, and Sylvia V. Baca, Acting Assistant Secretary (“Assistant Secretary”), Department of Interior Land and Minerals Management Service (“MMS”).
