Appellant was convicted of murder in theiirst degree, and his punishment assessed at confinement in the penitentiary for life, and he appeals.
The case ivas filed in the Dallas branch of this court on October 1, 1897, and was submitted on the 20th of April, 1898, at the Austin term. The record is written with a pen, and contains 436 pages; 215 pages thereof being the statement of facts.
