OPINION
WOLIN, District Judge.
This matter was opened to the Court by plaintiff, D.R., pursuant to Federal Rule of Civil Procedure 56 for an order granting plaintiff summary judgment and was responded to by way of a cross-motion for summary judgment by defendant, East Brunswick Board of Education (the “Board”). Having reviewed all the papers and briefs filed, the Court denies plaintiffs motion- and defendant’s cross-motion for summary judgment, and remands the matter to the Office of Administrative Law
