MEMORANDUM DECISION
WILLIAM R. SAWYER, Chief Judge.
This Adversary Proceeding was tried before the Court, without a jury, on May 28, 2008. Plaintiff Barbara Smith (“Smith”) was present in person and by counsel Charles M. Ingram. Defendants Homes Today, Inc. (“Homes Today”), and Steve Stutts (“Stutts”) were present by counsel Daniel W. Lee. At the time the case was called, the Plaintiff announced that a settlement had been reached with Defendants Royal Park Estates and Richard Dale Massey.
