MEMORANDUM OPINION

COOPER, District Judge.

Plaintiffs, former general category scallop permit holders, brought this action against the Secretary of the United States Department of Commerce (“Secretary”), the National Oceanic and Atmospheric Administration (“NOAA”), and the National Marine Fisheries Service (“NMFS” and, collectively, “defendants”).
