This matter is before the court on defendants’, Sears, Roebuck and Co., Sears Home Improvement Products, Inc. and Sears Holdings Corporation, motion for summary judgment. Oral argument was heard on defendants’ motion on November 10, 2010. For the reasons stated below, defendants’ motion for summary judgment is granted, and plaintiffs’ complaint is dismissed in its entirety.
