Suit by appellee against appellant to recover damages for the breach of a contract arising from the shipment of' certain lumber delivered by the plaintiff to defendant as a common carrier for hire.

The cause was tried upon count ten of the complaint and the general issue, resulting in a judgment for the plaintiff, from which the defendant prosecutes this appeal.
