This case was initiated by the filing of a complaint on June 24, 1974, challenging the constitutionality of the former § 419(b) of the Mental Health and Retardation Act of 1966, 50 P.S. § 4419(b).1 That provision, which allowed summary revocation of leaves of absences granted to patients of state mental health facilities, was found to be violative of plaintiff’s due process rights as secured by the Fourteenth Amendment.
