The plaintiff, John M. Peckham, III, appeals *283from a judgment for the defendant newspaper, the Boston Herald (Herald), on Peckham’s tort claim of public disclosure of private facts under G. L. c. 214, § 1B. The judge correctly allowed the Herald’s motion for summary judgment, although we modify to some extent the rationale relied on by the judge.
