Appeal from a judgment of the Supreme Court (Zwack, J.), entered October 10, 2008 in Ulster County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 70, and discharged petitioner.
In 1999, petitioner was convicted of criminal sale of a controlled substance in the third degree and sentenced as a second felony offender to a prison term of dVa to 9 years. Following his release on parole, petitioner was convicted of arson in the fourth degree in 2005 and sentenced as a second felony offender to IV2 to 3 years in prison.
