*1192Appeal from a judgment of the Supreme Court (Devine, J.), entered April 16, 2009 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of the Department of Correctional Services calculating his maximum period of imprisonment.

In 1991, petitioner was convicted of robbery in the first degree, criminal possession of a weapon in the third degree and criminal possession of stolen property in the third degree and sentenced to a maximum prison term of 12V2 to 25 years. In 1998, petitioner was sentenced as a second felony…
