In an action to recover damages for the breach of a contract to purchase real property, the defendants appeal from a judgment of the Supreme Court, Nassau County (Brucia, J.), dated May 15, 1986, which, inter alia, after a *410nonjury trial, is in favor of the plaintiff and against the defendant Sabbeth in the principal sum of $35,000, representing the down payment on the contract which had been placed in escrow and which ordered the defendant Max Weisler, as escrowee, to deliver the escrowed funds to the plaintiff.

Ordered that the judgment is affirmed, with costs.
