The events producing the litigation that resulted in the judgment appealed from, in so far as pertinent to our present inquiry, are substantially these: The Jolesch Shoe Company (Texas corporation) was a wholesale and retail dealer in shoes, maintaining its wholesale or jobbing house in the city of Dallas, and operated about 16 retail stores in different towns and cities of the state.
