In 1861, Thomas E. Tutt, Dent G. Tutt, and John F. Baker, had a claim against Wilkins T. Wheatly *183and Thomas F. Thatcher Tor money due, which claim they have ever since been trying to enforce. Portions of the litigation have been, to this court nine times, including the two cases which we now have under consideration. (See Tutt v. Ferguson, 13 Kas. 52; Scroggs v. Tutt, 20 Kas. 271.)
