| xThis case arose out of eight loans that Buford Quitman McDaniel (“Buford”) made to the appellant in the instant case, David Foscue (“Foscue”). When Buford died, he left the accounts receivable to his nephew, Robert Ben McDaniel (“Robert”), who also subsequently died. The appellee, Roland E. McDaniel (“McDaniel”), is the administrator of Robert’s estate, and he filed a complaint against Foscue to recover on outstanding debts, which he maintained were unpaid following Robert’s death.
