Appeal by the defendant,- Radcliffe Baldwin, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the-, county of Richmond on the 13tli day of January, 1910, upon the decision-of the court, rendered after a trial at the Richmond Special Term, overruling a demurrer to the amended complaint.

The plaintiff claims under an assignment from Standish B, Baldwin, and the facts alleged under the complaint are that “ on and prior to the 1st day of January, 1901, the defendant and one Austin P.
