The plaintiff, holder of a deed absolute on its face to the following described real property in Multnomah County, Oregon,

Lots 1 and 2, Block 15, Overlook, in the city of Portland,

upon which a motel property was built, brought this suit for the purpose of having the court declare he held this property in trust for the benefit of himself and the defendants David E. Mazzocco and Carmen P. Mazzocco.
