On the 5th of November, 1925, Irving H. Romm, agent, entered into an agreement with the defendants, William A. Lobosco and his wife, in which he agreed to sell to them certain properties on Jessup Street on the following terms: The purchasers agreed to pay $26,000; $1,000 on the signing of this agreement to be forfeited as liquidated damages in case of default by said party of the second part in the performance of the terms in the agreement, the balance, $3,500, by purchase of premises 3661 N. 21st Street and the balance in cash at the time of settlement.
