— Sometime prior to July 6, 1940, the appellant, William H. Tomlinson, obtained a judgment in the sum of $331.75 in the White Circuit Court against one William Zabel. The said Zabel was a married man at the time said judgment was procured, and his wife, Bertha, was then the owner of 60 acres of farm land in said county and she remained such owner until her death intestate on July 6, 1940.
