GRITZNER, District Judge.
This matter is before the Court on Plaintiffs Motion for Partial Summary Judgment (Clerk’s No. 31) and Defendant’s Motion for Summary Judgment (Clerk’s No; 30, 33). Attorney for Plaintiff is Charles Gribble; attorneys for Defendant are Hélén C. Adams and Bridget R. Penick.
