This is a bill in equity for the foreclosure of a mortgage of real estate. The facts upon which arise the questions reserved for our advice are embodied in the report of a committee appointed by the Superior Court, and are in substance the following:

On the 3d day of July, 1872, the respondent, being indebted to one John Munson by note of that date in the sum of $3,500 payable on demand, with interest annually at the rate of seven per cent, and taxes, executed and delivered to him a mortgage of real estate of that date to secure its payment.
