Plaintiff brought his action for brokerage commission in the salé of real estate and a garage business located thereon, claiming to have been employed by defendants to make the sale. Defendants filed their motion to strike the amended complaint and dismiss the suit on the ground that plaintiff had violated chapter 96, par. 4, sec. 1, Ill. Rev. Stat. 1947 [Jones Ill. Stats. Ann. 37.414(1)], which reads as follows:
