This is an appeal from a denial of a petition for writ of habeas corpus by the United States District Court for the District of Nebraska.

On October 16, 1961, Louis Wilson was tried before a jury in the State District Court of Douglas County, Nebraska, and found guilty of robbery. On December 7, 1961, he was sentenced to confinement in the Nebraska State Penitentiary for a term of five years. He and a co-defendant, Homer Charles Smith, appealed from the judgment of conviction to the Supreme Court of Nebraska. That court, in State v.
