OPINION

BRATVOLD, Judge.

Appellant, Armando DeLaCruz, Jr., appeals from his convictions of 20 offenses, arguing that the district court abused its discretion in denying his amended new-trial motion, which asserted that the state committed a Brady violation by failing to disclose critical impeachment evidence re garding the complaining witness. We hold that the district court erred by concluding it lacked discretion to consider appellant’s amended new-trial motion.
