The information in this case, filed in the district court of Latimer county July 19, 1923, in substance charged that, in said county, on or about the 28th day of April, 1923, B. W. Lowrance did, with the felonious intent to kill, shoot one Bud ¡Sales with a pistol. On the trial the jury returned a verdict finding the defendant guilty of assault with intent to kill as charged in the information, fixing his punishment at imprisonment in the penitentiary for a term of two years and nine months. From the judgment rendered on the verdict he appeals.
