Plaintiffs, Heritage Equity Group 401(k) Savings Plan and Max Dull, Trustee, of the Heritage Equity Group 401(k) Savings Plan, filed this action in state court against the Defendants Crosslin Supply Co., Inc. Profit Sharing/Savings Plan, and Greenpeace, Inc. 401(k) Savings Plan. Defendants removed this action to federal court on the basis of Employment Retirement Income Security Act (“ERISA”) federal preemption.
