This is an action brought by the plaintiff to recover damages for an injury alleged to have been caused by the negligence of the defendant while he was a passenger on one of its trains. By his answer the defendant denied the negligence alleged, and averred that the negligence of the plaintiff contributed to his injury. To this the plaintiff filed his reply, a.nd, issue being thus joined, the trial was proceeded with until the plaintiff rested his .case, when the defendant, by his counsel, moved for a judgment of non-suit, upon the ground that the evidence showed that the plaintiff was guilty…
