Appeal from an order of the Supreme Court (Williams, J.), entered February 15, 1994 in Schenectady County, which, inter alia, denied defendant’s cross motion for summary judgment dismissing the amended complaint.

Plaintiff, a provider of diagnostic testing and rehabilitative services to the medical and chiropractic communities, submitted claims to defendant, a not-for-profit health services corporation, for services rendered to certain of defendant’s subscribers.
