I. Background
Pro se petitioner Dwayne Ponder (“Ponder” or “petitioner”) seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254 challenging his state custody as the result of a judgment of conviction, following a jury trial in Monroe County Court, on two counts of robbery in the first degree (New York Penal Law (“P.L.”) § 160.15(2), (4)) and one count of grand larceny in the fourth degree (P.L. § 155.30(1)).
