Donald Hannah was charged with one count of the class C felony of second degree assault, pursuant to § 565.060, RSMo Cum.Supp.2010, 1 alleging Hannah recklessly caused serious physical injury to Donna Willis by pushing her off a porch. After a bench trial, the court found Hannah guilty as charged and sentenced him to five years imprisonment, subject to the 120-day callback provision of § 559.115.
