Tlie case was before us upon a former appeal. 202 Iowa 681. On that appeal, only the question of the statute of limitations was before us. That appeal was from the order of the district court directing a verdict for the defendant on the ground of the statute of limitations. We held, on the appeal, that the evidence in support of the defense of limitations was not conclusive, and that, therefore, a verdict should not have been directed.
