OPINION AND ORDER

KELLEY, District Judge.

Plaintiff Frank W. Jackson (“Jackson”), a fifty-six (56) year old African-American male, brought this Title VII action after being denied a promotion by the Military Sealift Fleet Support Command (“MSFSC”), 1 which is part of the United States Navy’s Military Sealift Command (“MSC”). Plaintiff Jackson was ranked seventh out of eleven candidates by a mixed race and gender panel of four supervisors. The Navy selected the top ranked candidate for promotion.
