Appeal from special term, Oneida county. Application for mandamus by the people, on the relation of George 0. Carter, against Frank Rice, secretary of state. From an order denying the application, plaintiff appeals.. Affirmed.

This was a motion for a peremptory mandamus requirng the secretary of state to immediately issue notices to the several county clerks of the state, stating the facts required by section 5 of chapter 680 of the Laws of 1892, and directing him to include in such notices the number of members of assembly from each county, directed, required, and allowed by the apportionment law as contained in chapter 208 of the Laws of 1879.
