Jonathan D. Smith (“Appellant”) filed a petition in the circuit court alleging numerous allegations against Michael Bower sox (“Respondent”). The caption of the petition purports to assert claims for “negligence, criminal negligence, reckless driving, respondeat superior, tampering -with mail, conspiracy & forgery [sic].” Respondent filed a motion to dismiss for failure to state a claim upon which relief can be granted pursuant to Rule 55.27(a). 1 The trial court sustained the motion and dismissed the petition with prejudice.
