The relators instituted- a certiorari proceeding for the purpose of reviewing the special franchise assessment of the New York & Queens County Railway Company in the borough of Queens for the year 1936. The relators are the receivers of the property of the New York & Queens County Railway Company, which is subject to the lien of the mortgage originally made by the Steinway Railway Company of Long Island City, and they maintain and operate a street surface railroad covered by such mortgage.
