The plaintiff corporation received a letter in February, 1963, from the then Commissioner of Public Works of the City of New York (not a named defendant in this action), advising it of plans of the Highway Department to grade, pave and lay sidewalks in the vicinity of the New York City Terminal Market in the Hunts Point Section of The Bronx, the cost of which would be at the general public expense and not by assessment against abutting property owners.
