BORAH, District Judge.

This is a libel in personam against Osaka Shosen Kaisha, a citizen of the Empire of Japan, for damage to certain shipments of coffee which were received on board the steamship Manila Maru for transportation from Santos, Brazil, to Galveston, Tex.; jurisdiction having been obtained by attachment of the steamship Havana Maru, a vessel owned and operated by respondent. The merchandise was shipped from Santos on September 29, 1926, under bills of lading which recited that it was “shipped in apparent good order and condition” and arrived at New Orleans, La., on October 25,…
