The plaintiff in error, hereinafter referred to as the defendant, was convicted of the crime of manufacturing intoxicating liquor, and his punishment fixed at imprisonment in the county jail for 30 days and a fine of $50. From the judgment the defendant has appealed to this court.

The defendant filed a demurrer to the information, in which he states the allegations do not constitute an offense against the laws of the state; which demurrer was overruled and the defendant duly excepted.
