Appeal by the defendant, Paul J, Bonwit, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 21st day of May, 1913, upon the verdict of a jury rendered by direction of the court.

On the 7th of March, 1900, Charles F. Ayer, as landlord, rented to the defendant certain real premises known as No. 20 West Twenty-third street in the city of New York, with the appurtenances, for the term of ten years from the 1st day of May, 1902, at the yearly rent or sum of $20,000 for the first two years, and $20,500 for the following eight years.
