— Appeal from an order of the Supreme Court at Special Term (Ford, J.), entered August 12,1982 in Saratoga County, which granted defendant City of Saratoga Springs motion to dismiss plaintiffs’ complaint as against it. On September 3,1980, plaintiff Marion H. Waring fell and sustained injuries while walking on a sidewalk on Granger Avenue in defendant City of Saratoga Springs (hereinafter city).
