The plaintiff sues to recover damages for personal injuries alleged to have been sustained by her as the result of a fall upon a sidewalk alleged to have been maintained by the defendant in a dangerous, defective and unsafe condition for a long period of time prior to the date of the accident to the knowledge of the defendant express or implied. As separate and distinct defenses in bar of the action the defendant alleges that the plaintiff has failed to allege compliance with the provisions of sections 33* and *50333-a* of its charter.
