This case is before the Court on a motion for partial summary judgment by the Plaintiff, the Federal Trade Commission (“FTC”), against Defendants Patriot Alcohol Testers, Inc. (“Patriot”) and Anthony J. Prall (“Prall”)- Specifically, the FTC asserts that it is entitled to summary judgment with respect to the following two issues: first, whether certain representations made by or on behalf of Patriot constituted “unfair or deceptive acts or practices” in violation of section 5(a) of the Federal Trade Commission Act (“FTC Act"), 15 U.S.C. § 45(a)(1)…
